Why We Need the Notwithstanding Clause

The Globe and Mail's website provides us with this excellent article by Montreal lawyer Anthony Wilson explaining why Canadians must keep the Notwithstanding Clause in the Canadian Charter of Rights and Freedoms. (Update: Ooops... although I was able to see the article without any obstacle, right now one needs to do the free registration thing on the G&M to get to it- sorry for the inconvenience).

Mr. Wilson explains it better than I can. I, for one, after reading his article, have no doubt whatsoever that we absolutely must keep the NWC!

A sovereign Supreme Court, operating in a political climate stigmatizing the legitimate exercise of democratic authority, robs a society of the most fundamental aspect of democracy. A legislature's strength, as expressed through its willingness to use the notwithstanding clause if need be, represents an act of tremendous political courage. Most important, it restores to the Canadian people their ultimate right to responsible government.
